Float Five
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and MountainPeak ("we", "us", "our"), a company based in Belgium, governing your use of the mobile game Float Five ("the Game"), available on iOS and Android.
By downloading, installing, or playing Float Five, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Game.
These Terms are governed by Belgian law and applicable European Union regulations, including the EU Consumer Rights Directive and the Digital Services Act (DSA).
2. Eligibility & Parental Consent
You must be at least 13 years old to use Float Five. If you are between 13 and 16 years old (the age of digital consent in Belgium), a parent or legal guardian must review and agree to these Terms on your behalf.
If you are a parent or guardian permitting a minor to use the Game, you accept full responsibility for their use, including any purchases made through the Game.
We reserve the right to verify age and to restrict or terminate access where we reasonably believe a user is below the minimum age.
3. User Accounts
To access certain features, you may create an account. You agree to:
- Provide accurate and truthful registration information
- Keep your password secure and not share your account with others
- Notify us immediately of any unauthorised use of your account at support@mountainpeak.be
- Take responsibility for all activities conducted under your account
We reserve the right to suspend or delete accounts that violate these Terms or remain inactive for an extended period.
4. Licence to Use the Game
Subject to these Terms, MountainPeak grants you a limited, non-exclusive, non-transferable, revocable licence to download and play Float Five for your personal, non-commercial use on compatible devices you own or control.
You may not:
- Copy, modify, distribute, sell, or sublicense the Game or any part of it
- Reverse engineer, decompile, or disassemble the Game
- Use cheats, bots, automation tools, or exploit bugs
- Use the Game for any commercial purpose without our written consent
- Remove or alter any proprietary notices or labels
5. In-App Purchases
Float Five offers optional in-app purchases, including virtual currency, power-ups, and cosmetic items. All purchases are:
- Processed through Apple App Store or Google Play and subject to their respective terms
- Non-refundable except as required by applicable law or platform policy
- Not redeemable for real money, goods, or other items of monetary value
- Forfeited if your account is terminated for violations of these Terms
EU/Belgian Consumer Rights: Under the EU Consumer Rights Directive, EU consumers have a 14-day right of withdrawal from digital content purchases. However, by starting a download or using virtual items immediately after purchase, you expressly consent to immediate performance and acknowledge that the right of withdrawal is lost upon use of the content.
Subscription purchases (if applicable) renew automatically. You may cancel at any time through your App Store or Google Play account settings.
6. Advertising
Float Five contains advertisements. By using the Game, you acknowledge that:
- Ads may be served by third-party networks, including Google AdMob
- Personalised advertising requires your separate consent (which you may withdraw in Settings)
- We are not responsible for the content of third-party advertisements
- Children-directed modes serve only contextual (non-personalised) advertisements
7. Intellectual Property
All content in Float Five - including but not limited to the game design, graphics, text, music, sound effects, code, and trademarks - is owned by or licensed to MountainPeak and protected by Belgian, EU, and international intellectual property law.
Nothing in these Terms transfers any intellectual property rights to you. You may not use MountainPeak's trademarks, logos, or branding without prior written permission.
8. Acceptable Use
You agree not to use Float Five to:
- Harass, bully, or harm other users
- Upload or transmit unlawful, offensive, or infringing content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the Game's operation or servers
- Engage in any activity that violates applicable law
9. Availability & Updates
We strive to keep Float Five available but do not guarantee uninterrupted access. We may:
- Update, modify, or discontinue features at any time
- Perform maintenance that temporarily affects availability
- Discontinue the Game with reasonable notice where possible
We are not liable for any loss of progress or virtual items resulting from updates, maintenance, or discontinuation, except where required by applicable consumer law.
10. Disclaimer of Warranties
To the maximum extent permitted by Belgian and EU law, Float Five is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.
11. Limitation of Liability
To the extent permitted by applicable law, MountainPeak shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Game.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under Belgian or EU consumer law.
EU consumers retain all statutory rights under applicable national and EU consumer protection law, which these Terms do not override.
12. Termination
We may suspend or terminate your access to Float Five at any time, without notice, if we believe you have violated these Terms or applicable law. You may delete your account at any time via in-game settings or by contacting us.
Upon termination, your licence to use the Game ends immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitation of liability) shall do so.
13. Governing Law & Dispute Resolution
These Terms are governed by Belgian law. Any disputes arising from these Terms or the Game shall be subject to the exclusive jurisdiction of the courts of Belgium.
EU consumers may also have access to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr for resolving disputes out of court.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-game notice or email at least 30 days before they take effect. Continued use of the Game after changes constitutes acceptance.
